1. Agreement
These Terms of Service ("Terms") form a binding agreement between you ("you" or "user") and Kempston Pilots, an independent game studio based in Córdoba, Argentina ("Kempston Pilots", "we", "us", "our"), governing your access to and use of the website located at https://kempstonpilots.com and all of its subdomains, including every game subdomain we operate (such as penaltyshootout.kempstonpilots.com, dunkerisland.kempstonpilots.com, overtakesprint.kempstonpilots.com, grandprixmoto.kempstonpilots.com, and unquested.kempstonpilots.com).
By loading any page served from a kempstonpilots.com domain you accept these Terms in full. If you do not accept them, please stop using the site.
2. What We Provide
Kempston Pilots publishes a small catalogue of free-to-play browser games, written tutorials about indie game development, and information about a paid live workshop. The games are served directly through the web browser with no account, no install, and no payment.
- Games. Free to play, browser-based, with optional global leaderboards.
- Tutorials. Free written guides about building and shipping web games.
- Workshop. Paid private-event workshop delivered by email arrangement. No checkout is provided on this site.
We may add, modify, or retire any of the above at any time. Leaderboards are provided on a best-effort basis and may be reset or migrated if necessary for technical or anti-abuse reasons.
3. Eligibility and Children
You must be at least 13 years old to use this site. If you are between 13 and the age of majority in your country, you may only use the site with the permission of a parent or legal guardian. The games and tutorials are not directed at children under 13, and we do not knowingly collect personal information from children under 13. See our Privacy Policy for details.
4. Acceptable Use
You agree to use the site only for lawful purposes and in ways that do not harm the service or its users. In particular, you agree not to:
- Submit leaderboard scores using automation, scripts, bots, reverse-engineered API calls, or any other means that bypass the normal gameplay loop.
- Submit offensive, hateful, sexual, threatening, defamatory, or misleading content as a player name / initials, or content that impersonates another person.
- Attempt to probe, scan, or tamper with the infrastructure that powers the site, including the Supabase leaderboard database.
- Use the site to distribute malware or phishing content, or to violate the rights of any third party.
- Scrape, mirror, or redistribute substantial portions of the site's content without prior written permission.
We reserve the right to remove any leaderboard entry, restrict access, or take any other technical or legal measure required to keep the service fair and safe. Decisions are made at our sole discretion.
5. Leaderboards and User-Submitted Content
When you submit a score, you may enter a short player name (initials). That name, alongside your score and the approximate city and country derived from your IP address, becomes publicly visible on the relevant leaderboard.
By submitting a score you grant Kempston Pilots a non-exclusive, worldwide, royalty-free licence to display, store, and reproduce that entry on the site and related promotional contexts. You are responsible for the content of the initials you submit. You can request the removal of a specific leaderboard entry by writing to hello@kempstonpilots.com.
6. Intellectual Property
The games, source code, text, illustrations, logos, and design of kempstonpilots.com are the property of Kempston Pilots or its licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted (for example, code samples shown in tutorials that you may copy and reuse for your own projects), you may not copy, modify, distribute, sell, or lease any part of our content without prior written consent.
Tutorial code snippets are provided for educational use and may be adapted freely in your own projects, including commercial ones. Attribution is appreciated but not required.
7. Third-Party Services
The site relies on third-party providers, including Netlify (hosting), Supabase (leaderboard database), Google Fonts (typography), ipapi.co (IP geolocation), Cloudflare (CDN / security), and Google AdSense (advertising). Each of those services is governed by its own terms and privacy policy. Their availability is outside our control, and temporary outages, rate-limits, or blocks on their side may temporarily affect parts of the site.
8. Advertising
This site is partly supported by advertising served by Google AdSense. Ads are only served after you give explicit consent via our cookie banner and may be personalised or non-personalised depending on your choices, your region, and applicable law. We do not endorse any product or service advertised on the site. Clicking an ad takes you to a third-party destination over which we have no control. See our Cookie Policy and Privacy Policy.
9. Disclaimers
The site and its contents are provided "as is" and "as available" without warranties of any kind, express or implied, including, to the fullest extent permitted by law, warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, free of malicious code, or that leaderboard data will always be preserved.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Kempston Pilots is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of the site, the games, or the tutorials, including loss of data or leaderboard standing. Our total aggregate liability to you for any claim relating to the site is limited to one hundred United States dollars (USD 100). Nothing in these Terms limits any liability that cannot be limited by law.
11. Indemnity
You agree to indemnify and hold Kempston Pilots harmless from any claim, loss, or expense arising out of your misuse of the site, your violation of these Terms, or your violation of any third party's rights.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Material changes will be announced on the home page for a reasonable period. Continued use of the site after changes take effect constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by the laws of Argentina, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally will be submitted to the courts of the City of Córdoba, Argentina, unless mandatory consumer-protection laws in your country of residence grant you a more favourable jurisdiction.
